# What Is Commercial Umbrella Insurance? How It Works for a NEMT Company

Commercial umbrella insurance is a liability policy that pays above the limits of your business auto, general liability, and other liability policies once a claim uses them up, and it can cover some claims those policies leave out. Some NEMT contracts require one: Verida's Georgia human services terms, posted September 2025, ask for $2 million.

- An umbrella pays, up to its own limit, after your auto or general liability limit is used up, so a large claim does not fall on your company alone.
- Contracts in Georgia, Texas, and Ohio ask for $1 million to $2 million of umbrella or excess coverage.

## How commercial umbrella insurance works

An umbrella is a second layer of liability coverage over the policies you already carry. The NAIC's glossary defines excess and umbrella liability as coverage above a specific amount set in a basic policy from your primary insurer, and says it can also fill gaps in that basic coverage. The California Department of Insurance adds that commercial auto, general liability, workers' compensation, or any other liability policy can sit under a commercial umbrella.

The umbrella waits its turn. The Maryland Insurance Administration's business owner's guide to commercial insurance says it pays up to its own limit when a claim goes past the limit of the policy under it. Here is how that plays out after a crash:

- Your wheelchair van's auto policy has a $1 million [combined single limit](https://nemtguide.com/glossary/combined-single-limit/), with a $1 million umbrella over it.
- A crash hurts two riders and the other driver, and the claims settle for $2.3 million.
- The auto policy pays its full $1 million first, then the umbrella pays its full $1 million.
- Your company owes the last $300,000. With no umbrella, it would owe $1.3 million.

An umbrella also matters when claims pile up over a year. The California guide explains that once total claims pass a general liability policy's aggregate, the policy pays nothing more that policy period, and a commercial umbrella protects you from the judgment above it. Verida's Georgia human services terms lean on this: an umbrella may meet their $2 million general liability aggregate, as long as it starts right where the $1 million primary limit ends.

It does not always start at your first dollar. When the umbrella covers a claim no policy under it covers, you pay a self-insured retention first. The California Department of Insurance says a retention of at least $10,000 is common.

## Umbrella vs excess liability

The NAIC glossary treats the two together, and so does the standard certificate. The ACORD 25 [certificate of insurance](https://nemtguide.com/glossary/certificate-of-insurance/) (2016/03 edition) gives them one row, with boxes for umbrella or excess, occurrence or claims-made, each occurrence, aggregate, and the deductible or retention.

The difference is in what they cover:

- **An umbrella** adds limits and can also reach some claims the policies under it leave out, after the retention.
- **An excess policy that follows form** adds limits on the same terms as the policy under it, so a claim your auto or general liability excludes stays excluded.

Contracts often spell out the features they want. Verida's Georgia terms require the umbrella to follow the form of the primary coverage. Hamilton County Job and Family Services' request for proposals for Medicaid rides (KB05-25R, December 2025) lists nine: an additional insured endorsement, pay on behalf wording, effective dates that match the primary policies, blanket contractual liability, punitive damages where the law allows, aggregates that apply as in the primary, care, custody, or control coverage, follow form, and a drop down feature. Give your agent the list word for word, and ask in writing which items your policy includes.

## Which NEMT contracts require an umbrella

The programs below show the range as of October 2026. Some set an umbrella minimum, and some let an umbrella stand in for other limits.

Texas's handbook tells health plans to make sure every ride provider other than a rideshare company carries the insurance in its section 5300, the section that lists the umbrella. MART's program-based transportation needs a $1 million combined single limit for vehicles seating 9 to 15, so a van seating 12, driver included, could meet it with $500,000 of business auto and an umbrella of at least $500,000 over it. Interstate trips work the same way. Federal law lets a passenger carrier build its required minimum from more than one source, as long as the total meets it (49 U.S.C. 31138(c)(3)). An excess policy's [MCS-90B](https://nemtguide.com/glossary/mcs-90b/) endorsement states the underlying limit it sits above.

### Your umbrella can protect the broker too

An umbrella you buy may cover more than your company. MTM Health's standard agreement, in the January 1, 2023 version Pennsylvania posts, sets no umbrella minimum, but it names MTM as [additional insured](https://nemtguide.com/glossary/additional-insured/) up to the greater of the minimum limits or your full liability and umbrella limits. MART names the state agencies and itself as additional insureds on the auto and umbrella or excess policies, and expects to be covered to the full extent of any coverage you buy above the minimum. Everyone named draws from the same limits.

## How to buy or renew an umbrella for a NEMT company

1. **Start from your contracts.** List each program's umbrella minimum, the primary limits under it, and whether an umbrella may count toward them. The [NEMT insurance requirements](https://nemtguide.com/guides/nemt-insurance-requirements/) guide lists each broker's primary limits.
2. **Check what sits under it.** Make sure the umbrella lists every policy a contract wants under it. Hamilton County wants it over both general liability and business auto.
3. **Ask for the named features.** Follow form, drop down, and the rest of any contract's list, in writing from your agent.
4. **Line up the dates.** Hamilton County requires the umbrella's effective dates to match the primary policies. Renewing them together avoids a gap.
5. **Ask the retention amount.** Plan to pay it on a claim the policies under the umbrella do not cover.
6. **Add the additional insureds.** When a contract names the umbrella, as MART and Hamilton County do, have the additional insured endorsement added to it as well.
7. **Update your certificate.** Have the umbrella row filled in on the ACORD 25, and send the new certificate to each broker.

Hamilton County accepts any mix of primary and umbrella limits that reaches its totals. Federal law lets an interstate passenger carrier build its minimum from more than one source. ### Does my personal umbrella policy cover my NEMT vans?

Do not count on it. The Maryland Insurance Administration tells businesses that rely on a personal auto or personal umbrella policy for company vehicles to read the policy closely, because many personal policies exclude business-related liability claims. Brokers also ask for commercial coverage in your company's name, so buy the umbrella as a commercial policy.

### What is a self-insured retention on an umbrella?

It is the part of a loss you pay before the umbrella responds to a claim no policy under it covers. The California Department of Insurance says a retention of at least $10,000 is common. Hamilton County makes providers declare any retention over $10,000 and guarantee they can pay it, and MART makes any deductible or retention the provider's own obligation.
